Technical faults on site mean downtime – and that costs money. Luibl Rental therefore maintains a replacement machine service and a technical standby service:

• In the event of a machine breakdown, replacement equipment is dispatched from the fleet.

• Fitters are available for maintenance and servicing assignments in France.

• Fast response time is a key quality feature of Luibl – particularly for cross-border deployments, where every lost working day counts double.

Expressly agree in the hire contract how replacement and support are handled in the event of a fault. You can obtain information on service times and conditions directly from Luibl.

Instructions, training and qualifications

In France, the provisions of the Code du travail apply, as do the standards of Decree No. 98-1084 on work equipment. The CACES system (Certificat d'Aptitude à la Conduite En Sécurité) applies to the use of lifting and conveying equipment:

Important: The CACES is not a driving licence but a certificate of competence for the safe operation of equipment. It is issued by approved certification bodies and has a limited period of validity (5 or 10 years depending on the category). Without a valid CACES, operating machinery in France is not permitted. In addition, French labour law requires instruction by the employer (formation à la sécurité) for every piece of equipment used.

Driving licence requirements

The EU-standardised driving licence system applies in France. Valid German, Austrian or other EU driving licences are recognised.

Tax obligations

Value added tax (TVA): Services connected with property (construction sites) are generally taxed in France where the property is located. The hire invoice may therefore be subject to French TVA (20%). Clarify this in advance with your tax adviser.

Permanent establishment risk: For longer-term construction sites in France (> 12 months under the Germany–France double taxation agreement), a permanent establishment may arise. Luibl Rental does not provide tax advice; please consult a tax adviser well versed in both countries.

On-site safety inspections

In France, labour law requires regular inspections of work equipment (Vérification générale périodique – VGP):

• Work platforms: VGP at least once a year

• Cranes: VGP every 6 months

• Forklifts: VGP at least annually

Luibl provides machines with a current inspection certificate. Inspection reports must be carried on site.

Occupational safety and working conditions

• Plan de Prévention: As soon as employees of different companies work together, a joint prevention plan must be drawn up.

• PPSPS: For larger sites with an SPS coordinator, a company-specific safety plan is required.

• PSI for crane operations: For mobile crane operations on larger sites, a PSI or a crane assembly plan is required.

Posting of employees (Détachement)

If Luibl sends fitters or crane operators to France, EU posting law applies (Directive 96/71/CE):

• Advance notification before the start of the posting.

• Appointment of a Représentant (representative) in France.

• Compliance with the French minimum wage (SMIC) and the relevant sector collective agreements (CCN).

• A1 certificates for posted employees must be carried.

• Keep posting documentation available on site or with the representative.

Choice of law

Luibl Rental's general terms and conditions stipulate German law as the place of jurisdiction and the applicable law. For cross-border hire contracts, this means that disputes are assessed under German law and at the German place of jurisdiction. Mandatory French consumer protection provisions remain unaffected. Please refer to the current terms and conditions.

Documents to be carried

• CMR consignment note: International road transport contract for every cross-border commercial transport.

• Registration documents: Vehicle registration of the transport vehicle and registration of any attachments subject to registration.

• CE declarations of conformity and operating instructions (available at least in French).

• Inspection certificates / VGP records for the machines.

• Special transport permit (Autorisation de Transport Exceptionnel – ATE) for over-width/over-length/over-height vehicles.

• Posting documentation / cabotage documents (if Luibl personnel travel along).

• Proof of insurance (Green Card / Carte verte).

• ADR documents for dangerous goods transport.

Registrations

Special transport permit France (ATE): Machines that exceed the permitted dimensions on the low-loader (width > 2.55 m, length > 18.75 m, height > 4.0 m, weight > 40 t) require an ATE. The application is submitted online before departure.

Posting notification (SIPSI): Advance notification of all posted employees is required.

Customs declaration: France is an EU member – no customs duties. In practice, there are no obstacles for hire equipment that demonstrably returns.

Transport responsibility and border crossing

As France is a member of the Schengen area and the EU, there are no systematic checks on persons at the German-French border. Goods inspections are possible. Responsibility for transport in the event of damage or loss is governed by the contractual agreements and the CMR convention. Luibl Rental clarifies in advance: who organises the transport – Luibl or the hirer? Details are set out in the hire contract (terms and conditions).

Registration and road use

• Machines subject to registration (e.g. truck-mounted work platforms) must have a valid EU registration.

• Machines not subject to registration (scissor lifts, excavators, telescopic handlers) are transported on low-loaders.

• Motorway toll (Péage): Chargeable in France; already included in the quotation.

• Sunday driving ban: Strict regulations for trucks over 7.5 t or 12 t – special permits are required for weekend journeys.

Liability of the hirer

Upon taking over the machine, the operating risk and liability for damage to the machine, to third parties and to the site pass to the hirer. The hirer is obliged to operate the machine properly, to deploy only qualified personnel and to comply with all relevant safety regulations. Details are governed by Luibl Rental's terms and conditions (terms and conditions).

The hirer's insurance obligations

• Public liability insurance: Must explicitly include cross-border deployment and the operation of hired machines. German policies often cover Germany only – check whether cover extends to France!

• Machinery insurance / hired equipment insurance: Protection against theft, vandalism, environmental damage and technical total loss.

• Transport insurance: For transporting the machine to and from the site.

• Crane insurance: Recommended for mobile crane operations in France and required on larger sites.

Note: Before the start of the project, clarify with your insurance broker whether your existing policies cover the use of machinery in France. A missing foreign extension can lead to considerable own risk in the event of a claim.

Luibl's liability

Luibl Rental is liable for providing the machine in a serviceable, inspected condition in accordance with the contract. Further exclusions and limitations of liability are set out in the terms and conditions.
